When do you need a sworn translation of your single status certificate?

A sworn translation of your single status certificate into Italian is required whenever the document must have official legal validity before Italian authorities. Here are the most common situations:

Getting married in ItalyIf you are a foreign citizen marrying in Italy, the Italian municipality (Comune) requires your single status certificate translated into Italian with a sworn translation, as part of the documentation under Art. 116 of the Italian Civil Code.
Nulla osta / Certificate of No ImpedimentYour Embassy or Consulate in Italy may issue a Certificate of No Impediment (nulla osta). If issued in English, it must be sworn-translated into Italian for submission to the Comune. In many cases, however, Consulates issue it directly in Italian.
Family reunificationThe Italian Immigration Office (Questura) may require a sworn translation of your single status certificate as part of the family reunification or residence permit application.
Italian citizenship applicationIf you are applying for Italian citizenship by marriage (cittadinanza per matrimonio), a sworn Italian translation of your single status certificate may be part of the required documentation.

Single status certificate, certificate of no impediment, affidavit of single status: what’s the difference?

Several documents can prove that a person is free to marry. The specific Italian authority you are dealing with may require a particular type:

Single Status Certificate An official document issued by a government authority (registry office, vital records office, or equivalent) certifying that a person is not currently married. This is the most common document requested by Italian municipalities.
Certificate of No Impediment (Nulla Osta) Issued by your Embassy or Consulate in Italy, it certifies that there is no legal obstacle to your marriage. Under Art. 116 of the Italian Civil Code, this is required for foreign citizens marrying in Italy. Most Consulates in Italy issue it directly in Italian; translation is only needed if it is issued in English or another language.
Affidavit / Sworn Declaration of Single Status A notarised statement in which the individual declares under oath that they are not married. Some countries issue affidavits rather than certificates. Italian authorities generally accept them, provided they are apostilled and sworn-translated into Italian.

Apostille and legalisation of the single status certificate

Before your single status certificate can be sworn-translated and used in Italy, it generally needs to be authenticated in your home country. There are two systems depending on which country issued the document:

✓ Hague Convention countries (Apostille) If your certificate was issued in a Hague Convention country (UK, USA, Canada, Australia, Ireland, New Zealand, South Africa, India, and most European and Latin American countries), you need an Apostille from the competent authority in the issuing country (e.g. the Foreign, Commonwealth & Development Office in the UK, the Secretary of State in the US). The apostilled document can then be sworn-translated into Italian.
⚠ Non-Hague countries (consular legalisation) If your certificate was issued in a country that has not signed the Hague Convention, it must undergo consular legalisation: the document is authenticated by the Ministry of Foreign Affairs in the issuing country, and then by the Italian Embassy or Consulate in that country. Only after legalisation can it be sworn-translated in Italy.

Important: the Apostille or legalisation must be applied to the original document before the sworn translation is made. We handle the translation and the sworn oath in Italy; the Apostille or legalisation of the original must be obtained in the country where the certificate was issued.

🇪🇺 EU exemption (Regulation EU 2016/1191) If your single status certificate was issued by an EU Member State and needs to be presented in Italy (or vice versa), you may not need an Apostille or a sworn translation at all. Since 2019, EU Regulation 2016/1191 allows you to request a Multilingual Standard Form from the issuing authority, which is accepted directly by the authorities of other Member States without further translation or authentication. The same principle applies to the multilingual Certificate of Marital Capacity under the Munich Convention. We recommend checking with the Italian authority whether they accept the multilingual form — if so, you’ll save time and money. If they specifically require a sworn translation, we’re here to help.
