When do you need a sworn translation of divorce documents?

Registering a foreign divorce in ItalyA divorce granted in the UK, US, Canada, Australia or another country must be registered (trascritto) with the Italian civil registry to take effect. The sworn translation of the decree absolute or divorce judgment is mandatory. For EU divorces, the Brussels II-ter Regulation (EU 2019/1111) applies; for non-EU divorces, recognition under Italian Law 218/1995.
Remarriage in ItalyIf you are divorced and wish to remarry in Italy, the municipality requires the translated divorce decree or certificate as proof that the previous marriage has been dissolved.
Remarriage abroad after an Italian divorceTo remarry abroad after divorcing in Italy, the authorities in the destination country require a sworn translation of the Italian divorce judgment or the divorce annotation on the marriage certificate.
Family reunification and residence permitsThe Italian Immigration Office (Questura) may require a sworn-translated divorce decree for family reunification, residence permit applications or to confirm civil status.
Cross-border child custody and maintenanceWhen divorced parents live in different countries, the custody and maintenance provisions in the divorce decree must be translated for enforcement in the country where the parent or child resides.

Which divorce documents do we translate?

Decree Absolute / Divorce Decree / Judgment of DissolutionThe court order that formally dissolves the marriage. Known as decree absolute in England & Wales (pre-April 2022), final order (post-April 2022), divorce decree or judgment of dissolution of marriage in the US, and equivalent orders in Australia, Canada and Ireland. This is the primary document for registration in Italy.
Consent Order / Financial OrderThe court-approved agreement dealing with the financial aspects of the divorce: division of assets, spousal maintenance (alimony), pension sharing. Relevant for enforcement in Italy or abroad.
Child Arrangements Order / Custody OrderThe court order setting out custody (affidamento), residence, visitation rights and child maintenance. Essential when parents reside in different countries.
Italian divorce judgment (Sentenza di divorzio)The Italian court judgment dissolving the marriage, including provisions on custody, maintenance and property. Foreign-resident ex-spouses often need this translated into English.
Divorce certificateA civil registry certificate simply confirming that a person is divorced — simpler than the full decree. May be sufficient for administrative procedures and remarriage.
Separation agreementsItalian separation agreements (separazione consensuale, negoziazione assistita) and foreign equivalents. Often needed as a precursor document before the divorce itself.

Recognition of foreign divorces in Italy: EU vs non-EU

🇪🇺 EU divorces — Brussels II-ter Regulation (EU 2019/1111) Divorces granted in EU Member States are automatically recognised in Italy without any intermediate proceedings. However, to register the divorce with the Italian civil registry, the municipality requires a sworn Italian translation of the decree, accompanied by the Article 36 certificate (a standard form confirming the judgment is final). No Apostille is needed between EU countries.
⚠ Non-EU divorces (UK post-Brexit, US, Canada, Australia, etc.) Divorces from non-EU countries are recognised under Italian Law 218/1995 (Article 64) if they meet certain requirements (jurisdiction, due process, not contrary to public policy). For registration, the municipality requires the decree apostilled (or legalised) in the issuing country and sworn-translated into Italian. If there are doubts about recognition, proceedings before the Court of Appeal may be necessary. Since Brexit, UK divorces follow this route.
🇪🇺 EU 2016/1191 — civil status certificates only Important distinction: EU Regulation 2016/1191 exempts civil status certificates (like a divorce certificate from the registry office) from Apostille between EU countries, and allows a Multilingual Standard Form. But it does not apply to court judgments (divorce decrees), which follow the Brussels II-ter regime. In practice: if you only need the registry certificate confirming “divorced” status, the multilingual form may suffice between EU countries. If you need the full decree, a sworn translation is required.

I have a UK decree absolute. How do I register it in Italy?
Since Brexit, UK divorces are recognised under Italian Law 218/1995 (not the EU regulation). You need to: (1) obtain the Apostille on the decree absolute from the FCDO; (2) have it sworn-translated into Italian — we handle this; (3) present the apostilled and translated decree to the Italian civil registry office (Comune) for registration.
